# Terms of Service for HeNåAnne

## 1. Introduction

Welcome to HeNåAnne ("Our Creative Universe"). These Terms of Service ("Terms") govern your use of our online stores, sales channels, and digital platforms, including but not limited to our [Shopify store](https://henaanne.myshopify.com), and your purchase of products from us. By placing an order, you agree to be bound by these Terms.

Our business sells original art, art prints, clothing, and other print-on-demand (POD) products via platforms such as Printful, Gelato, and Printify. We operate under Swedish law, and these Terms are drafted in accordance with Swedish consumer protection legislation, including the Distance Contracts Act (Distansavtalslagen) and the Consumer Sales Act (Konsumentköplagen).

## 2. Definitions

- **"We"/"Us"/"Our"** – HeNåAnne, the seller.
- **"You"/"Customer"** – the individual or entity placing an order.
- **"Products"** – physical goods sold through our stores (art prints, apparel, accessories, etc.).
- **"POD Partner"** – third‑party print‑on‑demand providers (Printful, Gelato, Printify etc) that manufactures and ship products on our behalf.
- **"Order"** – a binding agreement to purchase Products once we confirm acceptance.

## 3. Orders & Acceptance

- You place an order by completing the checkout process on any of our online stores, sales channels, or digital platforms.
- We will send an order confirmation email or equivalent confirmation through the platform used. The contract is formed when we send this confirmation.
- We reserve the right to refuse or cancel any order (e.g., incorrect pricing, suspicion of fraud, insufficient stock). If we cancel, we will refund any payment already made.
- All orders are subject to availability. POD Partners may occasionally discontinue certain products; if this occurs, we will notify you and offer a replacement or refund.

## 4. Prices & Payment

- Prices are displayed in your local currency where supported, or in USD by default. For customers within Sweden, prices may also be shown in Swedish Kronor (SEK). Applicable VAT (moms) is included where required by law.
- Shipping costs are calculated at checkout and are your responsibility unless otherwise stated.
- We accept payments through the payment methods made available on the respective platform or sales channel you are using, which may vary depending on location and customer. Payments are processed via our payment infrastructure, including Airwallex. All payment processing is secure and encrypted.
- We do not store your payment card details; they are handled by our payment processors.

## 5. Shipping & Delivery

- We ship worldwide. Shipping times vary depending on destination and the POD Partner's production schedule. Estimated delivery times are shown at checkout where available; for further details, you may also refer to our POD Partners.
- These are estimates only; we are not liable for delays caused by carriers, customs, or unforeseen events.
- You will receive a shipping confirmation email with a tracking link once your order is dispatched.
- Risk of loss or damage passes to you upon delivery

## 6. Right of Withdrawal (Returns)

- If you are a consumer within the EU, you have a 14-day right of withdrawal under the Distance Contracts Act (Distansavtalslagen). If you are located outside the EU, similar rights may apply under your local consumer protection laws.
- This means you may return a Product for any reason within 14 days of receiving it, where applicable.
- To exercise your right of withdrawal:
  - Notify us within 14 days of delivery by email to [henaannesweden@gmail.com](mailto:henaannesweden@gmail.com).
  - Return the Product unused, in its original packaging, with all tags/labels attached.
- You are responsible for the return shipping cost unless the Product is faulty or incorrect.
- Once we receive the returned Product, we will refund the purchase price (excluding original shipping) within 14 days, using the same payment method.
- Exceptions to the right of withdrawal: Custom-made or personalized Products (e.g., prints with specific sizing, custom text) cannot be returned unless faulty.

## 7. Faulty or Damaged Products

If a Product is defective, damaged in transit, or not as described, you have the right to a remedy under the Consumer Sales Act.

- Contact us within a reasonable time (preferably within 7 days of delivery) with photos of the issue.
- We will arrange a replacement, repair, or refund at our discretion.
- We may ask you to return the Product; we will cover return shipping costs for faulty items.

## 8. Intellectual Property

- All artwork, designs, and branding displayed on our Products are the intellectual property of HeNåAnne or its licensors.
- You receive a non-exclusive, non-transferable license to use the purchased Product for personal, non-commercial purposes.
- You may not reproduce, distribute, or create derivative works from the artwork without our explicit written permission.
- We reserve the right to take appropriate legal action in the event of any unauthorized use, reproduction, or infringement of our intellectual property.

## 9. Limitation of Liability

- We are liable for direct losses caused by our negligence or breach of contract, up to the value of the order.
- We are not liable for indirect, consequential, or incidental damages (e.g., loss of profit, data, or opportunity).
- Our liability is limited to the maximum extent permitted by Swedish law.
- We are not responsible for any errors or omissions in Product descriptions, pricing, or availability that originate from our POD Partners.

## 10. Force Majeure

We are not liable for delays or failures to perform caused by events beyond our reasonable control, including but not limited to: pandemics, natural disasters, strikes, war, terrorism, internet outages, or supply‑chain disruptions affecting our POD Partners.

## 11. Privacy

Your personal data is handled in accordance with our [Privacy Policy](https://henaanne.com/privacy). By using our store, you consent to the collection and use of your data as described therein.

## 12. Changes to These Terms

We may update these Terms from time to time. The latest version will always be posted accordingly. Changes will not affect orders already placed.

## 13. Governing Law & Disputes

These Terms are governed by Swedish law. Any disputes shall be settled in the Swedish courts, with the Swedish Consumer Agency (**Konsumentverket**) as the primary dispute‑resolution body for consumers.

As a consumer, you also have the right to submit a complaint via the [EU Online Dispute Resolution platform](https://ec.europa.eu/odr).
